As an immigration lawyer for citizenship and naturalization, J.R. Wiltshire Law works with clients on a variety of issues, including:

TYPES OF SERVICES IN DETAIL
  • CITIZENSHIP GENERALLY
  1. Birthright Citizenship is obtained when a child is born in the U.S.
  2. Citizenship by acquisition is obtained when a child is born in a foreign country to a U.S. citizen parent, although physical presence requirements exist.
  3. Citizenship by derivation occurs when a child’s parent becomes a U.S. citizen and then can pass citizenship to their child. I can assist you in applying for a Certificate of Citizenship (Form No. 600 or 600K) with USCIS to achieve this goal. A U.S. citizen can transmit citizenship to a biological or adopted child.
  • BECOMING A CITIZEN FROM  ASYLEE OR REFUGEE STATUS
    If your application for asylum is approved, you may eventually become eligible for citizenship, and it is important to be aware of the risks so that you do not unintentionally jeopardize your application. It is recommended to seek legal advice regarding the appropriate timing to apply for citizenship in such situations.
  • ADDITIONAL NATURALIZATION AND CITIZENSHIP SERVICES
  1. Green Card/Permanent Residence – I will assist you in obtaining LPR status if you are eligible for it through any form of granted immigration relief. This is the step that precedes becoming a U.S. citizen through naturalization.
  2. Changing Visa Status – I can help clients transition from one visa category to another through the USCIS.
  3. Immigration Reform – I will keep my clients updated on immigration reform and any relevant naturalization news as it arises and pertains to their case.
  4. Prosecutorial Discretion – The USCIS may exercise prosecutorial discretion in certain cases. Whether it pertains to an application denial or a matter pending in immigration court, I will advocate for prosecutorial discretion (PD) on your behalf from the DHS attorneys at the Office of the Principal Legal Advisor (OPLA).

The immigration system has rigorous standards, and properly applying for citizenship can be a complicated and confusing process. The longer you delay seeking legal help, the more difficult your case can become.

Citizenship can be obtained by naturalization, by Marriage, citizenship through your parents, and citizenship through the military. Speak to an immigration lawyer if you have questions about your eligibility for naturalization or passing on citizenship, as the laws can be complex and differ depending on the particular facts in a person’s case.

No, you do not need a lawyer to apply for citizenship. However, a lawyer can ensure your application is properly completed and that you are ready for the process of passing the citizenship exam and interview. 

The citizenship exam tests English proficiency and civics (knowledge of U.S. politics, government, and history). The person must pledge allegiance to the United States government. The applicant must also demonstrate that they have a good moral character and will remain loyal to the U.S. Constitution.

Unlike LPRs, USCs cannot lose their status by living outside the U.S. for extended periods of time (or even permanently), after becoming a USC.  Even criminal convictions will not strip someone of their U.S. citizenship (with a few rare exceptions). Also, if you naturalize, your LPR children under age 18 who are residing with you will automatically become USCs. For these reasons, it is important to speak to a qualified legal representative as soon as you are eligible to apply for citizenship (you have been an LPR for five years or three years for LPRs married to USCs) to determine whether you are eligible to naturalize.
